Terms and Conditions
The following Terms and Conditions govern your request, purchase, or receipt of data recovery services provided by Data N Recovery (“Data N Recovery,” “we,” “us,” “our,” or the “Laboratory”).

We encourage you to read these Terms and Conditions carefully before submitting a data recovery case. By submitting a case, shipping a device, or authorizing services, you agree to be bound by these Terms and Conditions. Data N Recovery reserves the right to update or modify these Terms at any time without prior notice.
Evaluation Process
The purpose of the evaluation process is to assess the condition of the submitted storage device, determine the likelihood of successful data recovery, and estimate the resources required (including engineering time and replacement components) in order to provide an accurate service quote.
Evaluation fees must be paid in advance. Customers will be informed in advance of any additional evaluation-related fees.
If the customer does not ship the device to the laboratory, evaluation fees are refundable upon request within three (3) business days. If the device has been delivered to the laboratory or a prepaid shipping label provided by Data N Recovery has been used, the evaluation fee becomes non-refundable.
Service Quote and Authorization
If you accept the quoted price and service terms, you must electronically sign the service authorization and provide valid payment information to proceed with the data recovery process.
Turnaround times are estimates provided under normal conditions. Due to the technical nature of data recovery, unforeseen complications may arise that require additional time. By authorizing service, you acknowledge and accept potential extensions to estimated turnaround times.
Recovered data storage media (e.g., new external drives) are not included in the quoted recovery price and will be billed separately. Where feasible and based on data size, recovered data may be delivered via secure cloud storage.
The customer is responsible for submitting the correct storage device. Data N Recovery is not responsible for errors in device submission. If services are authorized and performed on an incorrectly submitted device, the customer remains responsible for all authorized service fees.
Completed Recovery Service
We will use reasonable and industry-standard methods to recover all recoverable data from the submitted device. If data is successfully recovered, you will be notified to verify the results prior to final delivery. Additional terms related to completed services may be outlined in separate service documentation.
Data Delivery Options
Recovered data will not be released until all outstanding fees have been paid. Data may be delivered by one of the following methods:

Secure, temporary cloud-based access for download

Shipment on a brand-new external storage device
All return media are encrypted by default to protect data during transit.
Unsuccessful Recovery
If data recovery is determined to be unsuccessful, you will not be charged for the recovery service itself, except in cases involving non-refundable upfront fees.
Return of Original Media
Original devices may be returned upon request. Return shipping costs will be charged to the customer.
Do not send cables, adapters, or accessories. Enclosures, cables, and packaging may be removed and are not retained.
Certain devices (including all-in-one computers) may be rendered unusable during evaluation or recovery attempts. In such cases, the device may not be returnable.
Disposal of Abandoned Media
Any storage device left without communication for more than thirty (30) days may be disposed of, reused, or recycled. You release Data N Recovery from confidentiality obligations related to abandoned media. A certificate of destruction may be provided upon request.
Service Limitations
You acknowledge that data recovery is not guaranteed. Storage devices may degrade further or become unrecoverable at any stage, including while in our possession. Data N Recovery assumes no responsibility for such outcomes.
Payment Terms and Plans
A valid payment method must be provided. Recovery services generally do not require full upfront payment. Payment plans may be offered at our discretion. Specific payment terms are outlined in separate service documentation.
Refunds

Evaluation fees are refundable only if the device is not shipped and a refund is requested within three (3) business days

Evaluation fees are non-refundable once a device is received or a shipping label is used

Upfront service fees, if applicable, are non-refundable

Once recovery results are verified remotely, no refunds will be issued
Taxes
Applicable federal, provincial, or local taxes will be charged in accordance with Canadian law.
Authorization
By shipping your device, you authorize Data N Recovery and its employees, contractors, and agents to transport, inspect, evaluate, and attempt recovery of the submitted device and its data.
Legal Ownership and Rights
You represent and warrant that:

You are of legal age

You are the lawful owner or authorized representative of the device and data

The data is lawful and you have full rights to submit, recover, and receive it
You agree to indemnify and hold harmless Data N Recovery from any claims arising from ownership disputes or unlawful data.
Confidentiality
Data confidentiality is a priority. We will protect submitted and recovered data from unauthorized access and will use it solely for data recovery purposes, except where disclosure is required by law.
Disclaimer
All data recovery services are provided “as is” without warranties or guarantees of any kind. Recovery attempts are performed at the customer’s sole risk.
Limitation of Liability
To the maximum extent permitted by applicable Canadian law, Data N Recovery’s total liability shall not exceed the amount paid for services. We are not liable for loss of data, device damage, lost profits, or indirect or consequential damages.
Transportation and Shipping
Data N Recovery is not responsible for damage or loss during shipping to or from our facility. Customers may insure shipments at their own expense. Claims for shipping damage must be pursued with the courier.
Personal Data
You agree to provide accurate and up-to-date personal information. Data N Recovery is not responsible for issues arising from incorrect or outdated information.
Compliance with Laws
You agree to comply with all applicable laws. Data N Recovery reserves the right to report violations to authorities and cooperate with investigations.
International Trade Compliance
Services are subject to applicable export control and trade laws. We reserve the right to refuse service where legal restrictions apply.
Dispute Resolution
Disputes shall be resolved through:

Mediation (if negotiation fails)

Binding arbitration in Ontario, Canada, governed by Ontario law
By agreeing to these Terms, you waive the right to pursue disputes in court.
Assignment
You may not assign these Terms without written consent. Data N Recovery may assign its rights and obligations with notice.
